Terms and Conditions

PRICES: All prices FOB our nursery. This price list is intended for members of the wholesale trade only and cancels all previous lists. Prices are subject to change without notice. A 15% surcharge will be added for off-season digging.

DELIVERY: Delivery charges will be finalized at time of delivery.

TERMS: First time buyers are subject to deposit before order is dug. Cash or 30 day net to customers with pre-approved credit. Such accounts are due and payable 30 days from delivery. Accounts unpaid at this time will be subject to 1 ½ % service charge monthly.

GUARANTEE: Great care is taken to keep all stock offered for sale by Twitty Nursery true to name and in good condition up to delivery date. Should any merchandise prove otherwise, it is agreed by all parties concerned, that we are not liable for any amount greater than the purchase price.

LIABILITY: We book all orders with the distinct understanding that we shall not be liable for injury to stock from frost, hail, fire or other causes beyond our control. We are not liable for delays in transit; our responsibility ceases upon delivery to transportation company. It is understood that all orders accepted are subject to availability of stock at the time of delivery.

CLAIMS: No claim for rejections or deficiencies will be entertained unless made within five days after arrival of goods.
